Cancelation of Removal for LPR

The cancellation of removal for permanent residents who risk losing status for actions that constitute grounds of deportability or inadmissibility is available to those who have been LPRs for a minimum of five years. They must have resided in the United States in some status for at least seven continuous years, and have not been convicted of an aggravated felony.

Cancelation of Removal for non-LPR

Cancellation of removal for non–LPRs is available to persons who have resided continuously in the United States for at least 10 years, are of good moral character, and have not been convicted of any crimes described in the deportability and inadmissibility provisions. They also must show that their removal would cause exceptional and extremely unusual hardship to their U.S. citizen or LPR child, spouse, or parent. This form of cancellation is limited to 4,000 persons per year.
